1. ACCEPTANCE OF TERMS
By downloading, installing, or using the Evara application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Red Feather Industries, a trade name of Fleet Lifestyle LLC ("we," "us," or "our").
2. ELIGIBILITY
You must be at least 18 years of age to use Evara. By creating an account, you represent and warrant that you are 18 or older. We reserve the right to terminate any account we believe belongs to a user under 18. We do not knowingly collect data from minors.
3. APPLE APP STORE ADDITIONAL TERMS
These Terms are between you and Red Feather Industries only, not Apple Inc. Apple is not responsible for the App or its content. To the extent permitted by law:
- Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for any product liability claims related to the App.
- Apple is not responsible for any intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you.
- Your use of the App must comply with Apple's App Store Terms of Service.
4. ACCOUNT REGISTRATION
You register for Evara using your phone number, which we verify by sending a one-time passcode (OTP) via SMS. Currently, phone number verification is our primary account registration method. We may also offer Sign in with Apple or Google Sign-In as alternative or additional registration options; where available, these are subject to Apple's and Google's respective terms, and may share your name and email address with us as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide a valid, currently-reachable phone number and accurate profile information, and to keep it up to date. Standard message and data rates from your mobile carrier may apply to verification messages.
5. USER CONDUCT
By using Evara, you agree not to:
- Create a false or misleading profile.
- Impersonate any person or entity.
- Harass, threaten, or abuse other users.
- Post or transmit content that is offensive, illegal, or violates the rights of others.
- Use the App for commercial solicitation or spam.
- Attempt to reverse engineer, hack, or otherwise interfere with the App.
- Use automated bots or scripts to interact with the App.
- Use the App for any unlawful purpose.
We have zero tolerance for objectionable content or abusive users. We reserve the right to remove any content and to suspend or terminate accounts that violate these rules at our sole discretion, without prior notice.
6. USER-GENERATED CONTENT
You retain ownership of any content you submit (photos, profile information, messages, etc.). By submitting content, you grant Red Feather Industries a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating and improving the App. You represent that you have the right to grant this license and that your content does not violate any third-party rights.
7. CONTENT MODERATION
To help keep Evara safe, we use a combination of automated tools and human review. Photos you upload are checked automatically for explicit or otherwise objectionable imagery, and a photo our systems cannot confirm is safe is removed. Messages are checked by an automated classifier. Profile text, such as your bio, is not screened before it appears — it is reviewed by our team when another user reports it. Automated checks may result in content being removed or an upload being rejected without prior notice. You can report content or another user directly in the App at any time; reported content is reviewed by our team, and reporting someone also blocks them immediately. See our Privacy Policy for more on how automated screening works and what data it involves.
8. MATCHING, MY CIRCLE, AND APP FEATURES
Evara uses user-inputted traits and profile information to suggest potential matches. We do not guarantee that the App will result in any particular outcome, including but not limited to romantic connections, relationships, or meetings. Match suggestions are algorithmic and are not endorsements of any user.
Evara also offers "My Circle," an optional feature that lets you find friends and mutual connections who already use Evara and receive vouches from them. If you choose to use My Circle and grant Evara access to your device's contacts, we process your contacts as described in our Privacy Policy. My Circle is optional — you can use Evara's core matching features without granting contacts access.
Evara is launched market-by-market (a "geo-gated" rollout). Certain features may only be available, or may behave differently, depending on your verified location and whether your area is part of an active launch market.
9. OCEAN — AI-ASSISTED FEATURES
Evara includes "Ocean," an optional AI assistant that can help you with things like drafting messages, planning dates, and getting quick answers about the App. Ocean is powered in part by third-party AI models (see our Privacy Policy for details on how your data is processed). By default, Ocean does not see the content of your conversations with other users — it only reads that content, and only for the specific conversation, if you explicitly ask it to draft a reply and confirm that request in the App. Ocean's suggestions are generated automatically and are not reviewed by a person before being shown to you; they may be inaccurate, out of character, or not what you intended, and you're responsible for reviewing anything Ocean drafts before you send or act on it. You can control what Ocean remembers about you, and delete that memory at any time, in Settings.
10. IN-APP PURCHASES AND SUBSCRIPTIONS
Evara may offer premium features through in-app purchases and subscriptions processed via Apple's App Store. All purchases are subject to Apple's payment terms. We do not process payment information directly. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel subscriptions through your Apple ID Account Settings. All purchases are final and non-refundable except as required by applicable law or Apple's refund policies.
11. INTELLECTUAL PROPERTY
All content, trademarks, logos, and intellectual property associated with Evara and Red Feather Industries are owned by or licensed to us. You may not use, copy, reproduce, or distribute any of our intellectual property without our prior written consent.
12. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE.
13. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, RED FEATHER INDUSTRIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Red Feather Industries, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your content, or your violation of these Terms.
15. TERMINATION
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App immediately ceases. You may delete your account at any time through the App's settings.
16. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
17. CHANGES TO TERMS
We may update these Terms at any time. We will notify you of material changes via the App or email. Continued use of the App after changes constitutes your acceptance of the revised Terms.
